OTI Urges FTC To Curtail Unfair and Deceptive Practices by Commercial Entities

On Monday, OTI filed comments urging the Federal Trade Commission to use the full extent of its rulemaking authority to curtail the unfair and deceptive commercial surveillance and data security practices in which many commercial entities engage.

OTI also joined comments to the FTC’s Rulemaking on the subject of commercial surveillance to “highlight one worrisome aspect of commercial surveillance that is not captured in the ANPR but that demands the Commission’s attention: the government’s use of commercially available data to evade legal requirements set forth in the Fourth Amendment and various privacy laws enacted by Congress.” OTI has repeatedly highlighted the harms posed by government purchases and use of data from data brokers.
