Surveillance of Students and Employees is Not the Cure

Abstract

This report builds on an event hosted on October 15, 2020 by New America’s Open Technology Institute (OTI) that explored the implications of health and productivity monitoring of students and workers during the pandemic. A panel, moderated by Christine Bannan, OTI policy counsel, brought together Sarah David Heydemann, Senior Counsel for Education and Workplace Justice at National Women’s Law Center; Wilnieda Negrón, Director of Policy & Research at Coworker.org; Anisha Reddy, Youth & Education Privacy Policy Counsel at Future of Privacy Forum; and Kent Wada, Chief Privacy Officer and Director of Policy and Governance at UCLA. This panel was followed by closing remarks from Rep. Anna Eshoo (D-Calif.), the Chairwoman of the Subcommittee on Health and a Member of the Subcommittee on Communications and Technology. Rep. Eshoo discussed the Public Health Emergency Privacy Act of 2020, a piece of COVID-19 privacy legislation which she introduced and OTI welcomed. The panel discussed key questions regarding the state of student and worker privacy during the pandemic, including: Are surveillance tools being deployed during the pandemic effective and appropriate responses to limiting the spread of COVID-19? What guardrails can and should be put in place to protect student and employee rights, along with their health?

This report is the sixth in a series of reports and events that focuses on important aspects of the privacy debate—covering civil rights aspects of privacy, whether current online business models are conducive to strong privacy protections, enforcement mechanisms, digital security, the use of algorithms, and more.
