This week, the Energy & Commerce Committee in the House of Representatives will be considering the Data Security and Breach Notification Act of 2015. The Open Technology Institute was critical of an earlier draft of the bill, and in testimony delivered at a subcommittee hearing last month, OTI Senior Policy Counsel Laura Moy outlined a number of shortcomings of the bill.

As the bill moves forward in the House, OTI has also signed on to a letter with other consumer and privacy advocates opposing the bill, and has prepared some one-page public educational materials further explaining key problems with the bill.

For convenient access, every piece of analysis OTI has prepared on this bill is linked to below:

  • Senior Policy Counsel Laura Moy's March 18, 2015 testimony before the Commerce, Manufacturing, and Trade Subcommittee of the House Energy & Commerce Committee.
  • Laura Moy's March 23 piece in Future Tense on implications of the bill for sensitive information about private communications.
  • April 9 letter from OTI and other consumer and privacy advocates to the Energy & Commerce Committee urging opposition to the bill.
  • Laura Moy's responses to questions for the record from Representative Jan Schakowsky.
  • OTI educational one-pager comparing pros and cons of the bill.
  • OTI educational one-pager explaining how the bill would dramatically weaken protections for communications information.
